Amendments to the Master Deed for West Winds

SUMMARY OF AMENDMENTS

First Amendment (December 12, 2023)
Key Changes: The property was divided into two parcels:

  • Phase 1: 67 units on 31.01 acres.

  • West Winds Future Development: 86.79 acres.

Second Amendment (February 2, 2024)
Key Change: The road name "River Bend" was changed to "West Winds Drive" to comply with address approval requirements by the Genesee County Road Commission.

Third Amendment (April 2, 2024)
Key Change: Added a provision in the Master Deed addressing well water treatment responsibilities.

  • Builders must test wells for arsenic and, if necessary, install treatment systems (e.g., reverse osmosis) to meet USEPA standards.

Fourth Amendment (August 9, 2024)
Key Changes:

  • Clarified trash removal responsibilities: Trash collection is to be managed by a contractor the Township of Fenton chose, with costs included in individual Unit Owners' tax bills.

  • Portable basketball hoops are prohibited in the street. They are allowed in driveways but must remain within 25 feet of the garage and within one foot of the driveway edge when not in use. Hoops must always be upright or stored in the garage. More than two violations will result in a $25 daily fine per occurrence.

  • Sheds must match the unit's exterior colors and materials, including shingles, and cannot exceed 100 square feet. They must be placed in the rear of the lot, at least 10 feet from the rear lot line, and align with the side lot line or the furthest flat surface available. Sheds require a concrete slab foundation and prior written approval from the Developer during the development period or the Association afterward, detailing location, size, and materials.
